Decree 3/2004 has approved the Price Regulations for Public Telecommunications Services. The decree was enacted in the context of increasing telecommunications liberalization in Angola, and sets forth: (i) a pricing policy to be adopted by public sector operators, and their agents or other intermediaries, for the provision of telecommunications services; and (ii) the prices to be charged between public sector operators for the interconnection of public telecommunications networks.

To further the achievement of these goals, the telecommunications taxation unit has been created. This unit will be used by all operators to assess and publish prices, as well as for invoicing purposes. The unit will have an equivalent amount in local currency indexed to the consumer price index, so that prices reflect the cost of services both in telecommunications taxation units and in Angolan kwanzas.
Competition issues have also been considered. Decree 3/2004 clearly forbids operators with significant market power from implementing general and long-term price drops with the aim of eliminating competition and thus creating or preserving a monopoly. Discount policies which are deliberately aimed at distorting competition are also prohibited.
Operators will incur financial penalties for breaches of the price cap obligation, as well as for refusals to provide information or the provision of false information.
